If parents cannot agree on child custody arrangements, then the case will proceed as litigation and end up in court - first in a temporary hearing and later in a trial if the spouses still cannot come to an agreement. The court will usually award child custody to the parent who has been the primary caretaker in the past, if that parent will continue to have the financial, emotional and time resources necessary for parenting. The other parent will usually be awarded substantial visitation rights. Depending on the ages of the children and the circumstances of the family, some of the questions the court may consider in awarding custody include:
- Who takes the children to school and picks them up?
- Who assists with the child's homework?
- Who attends child-parent-teacher conferences?
- Who attends the children's art performances or sporting events?
- Who makes pediatrician's appointments?
- Does each parent know the name of the child's doctor and nurse?
- Who plans/organizes play dates/parties for the children?
- Is either parent frequently away from home due to work or other obligations?

Legal Terminology
In Texas, the custodial parent is called "the sole managing conservator of the child or children." The parent with visitation rights is called "the possessory conservator of the child or children." Parents with joint custody are called "joint managing conservators."
